Purchase and mortgage: separate eligibility and document checks

This page concerns ordinary private property; subsidised housing has separate purchase and transfer restrictions. Purchase, lending and immigration eligibility are different. Banks assess income/assets, debt, credit, valuation, use and term; a published maximum loan ratio is not a personal offer.

Purchase and mortgage: separate eligibility and document checks
GroupCommon preparation
Buyers/borrowersIdentity/passport, address and customer details for buyers, borrowers and guarantors; company buyers add registration, directors/controllers and authorisations.
Income/debtPayslips, tax records and salary deposits; self-employed/variable earners add accounts and relevant longer records; existing loans/repayments. Confirm the bank’s required period.
Property/fundingSale agreement/attachments, deposits, property details and applicable tenancy; transaction funding evidence for bank/solicitor checks.
Before signingSolicitor checks title, restrictions and payment obligations; bank checks valuation and lending feasibility/conditions. Allow for a loan shortfall.

We help check requirements and organise records. Lawyers assess legal matters; banks assess lending. Finance is not confirmed until the loan is formally approved.

Mortgage eligibility: assessed by the bank

Prepare continuing-income, existing-loan, credit and funding evidence. Self-employed applicants, variable earners, corporate buyers and guarantors need the bank’s relevant checklist. Advertised maximum lending ratios do not establish individual eligibility.

Property documents: legal checks

Gather the sale agreement and attachments, title records, applicable leases, permitted use and known restrictions. Ask your lawyer to check their legal effect and contractual obligations, and identify missing documents or further checks.

Plan the transaction sequence

  • Before viewings: establish intended use, area and property information to check.
  • Before signing: have title and terms reviewed and confirm lending conditions with the bank.
  • After signing: complete the requested lending, identity and transaction records.
  • At handover: check the property, inventory and supporting records.

New and resale properties have different documents; use the checklist for the actual transaction.

For new homes, also check the sales brochure and sales arrangements. The licensed agent or seller supplies property-condition, use and sales documents.

Questions you may have

What should I check before letting out a property?

Ask your lawyer and bank to check permitted use, existing leases, mortgage conditions and restrictions. We help organise property and tenancy records.

Does buying property by itself provide Hong Kong residency?

No. Property purchase and immigration are assessed separately. An investment immigration application must also meet the applicant, permitted-asset and other scheme requirements.
